The government can change the quota if it wants, the High Court ruling has revealed

The court issued a partial verdict on the invalidation of the circular that sought to cancel the freedom fighter quota


The High Court has published the main part of its verdict declaring the 2018 circular canceling the quota system in government jobs as invalid. According to the verdict, the government retains the authority to change and expand the quota system if it chooses. If the quota is not fulfilled, appointments can be made on the basis of merit.

The High Court bench of Justice KM Kamrul Quader and Justice Khizir Hayat announced the verdict on Thursday (July 11).

On June 5, the High Court declared invalid the decision to cancel the quota system for first and second class freedom fighters in government jobs. Subsequently, on June 9, the state filed an application to suspend the High Court's judgment. On that day, the Chamber Court forwarded this application to the Appellate Division for a hearing.

Attorney General AM Amin Uddin stated that the Appellate Division will make the final decision on whether the High Court's ruling to cancel the quota system will be upheld or overturned.

On October 4, 2018, the Ministry of Public Administration issued a circular abolishing the existing quota system for direct recruitment to first and second class posts in government jobs.

On Wednesday (July 10), the Appellate Division issued a four-week stay on the High Court's ruling, declaring the circular canceling the freedom fighter quota system in first and second class government jobs illegal. The court also instructed the state and the students to file leave to appeal against the High Court verdict. The next hearing is scheduled for August 7.

As a result of this order, the 2018 government circular canceling the freedom fighter quota is currently suspended. A five-judge appellate bench led by Chief Justice Obaidul Hasan passed the order.
