High Court overturns decision to dismiss Wasa DMD Yazdani

The High Court has declared the dismissal of Syed Golam Yazdani, the deputy managing director (DMD) of the Dhaka Water Supply and Sewerage Authority (Wasa), illegal.

The High Court bench comprising Justice Sheikh Hassan Arif and Justice Md Bazlur Rahman announced the verdict on Monday after declaring the rule issued in this regard.

Previously, the court had issued a ruling questioning why Yazdani's dismissal should not be declared invalid.

On June 22, 2023, Yazdani was dismissed from his position as DMD (Human Resources and Administration) following a decision made during the 304th meeting of the board at Wasa Bhaban in Karwan Bazar.

Dhaka Wasa Board Chairman Dr Sujit Kumar Bala explained: "The DMD did not have a good relationship with the Managing Director (MD) Taqsem A Khan. This strained relationship was affecting many work. In the interest of Wasa, the proposal for Yazdani's dismissal was included in the agenda of the 304th board meeting. However, board members objected, mentioning that dismissing someone without giving them a chance to defend themselves was unacceptable. Despite this, the MD and chairman decided to release Yazdani without considering the board members' opinions.”

On May 16, 2022, Syed Golam Yazdani was appointed as DMD (Human Resources and Administration) by the Wasa Board, with the expectation that he would serve a three-year term until May 15, 2025. Yazdani's objections to certain inconsistencies within the Wasa administration led to displeasure. MD Taqsem A Khan was particularly angered by Yazdani's statements and informed him that he had no legal right to make such statements. Subsequently, Yazdani was dismissed from his position.

Yazdani challenged this decision by filing a writ, which led to the High Court issuing a ruling on the matter.
