In a written speech at the press conference, Advocate Matiur Rahman Akand said that Mia Golam Parwar was arrested on September 6, 2021, from a domestic meeting of the organization. The next day on September 7, he was brought to court and remanded for 4 days and then 2 more days. He was granted bail by the High Court on November 8. The Appellate Division upheld his bail when the government appealed against his bail. On February 14, 2022, just before he was released from jail, he was remanded for 3 days with another false case. On April 24, 2022, he got bail again from the High Court.
When the government again appealed to cancel his bail, the country's highest court rejected the government's appeal.
Before he was released from jail, he was again arrested in a case on May 30, 2022, based on the alleged complaint of the ACC. He was granted bail by the High Court on March 30 this year in the said case. This time the government appealed and the chamber judge rejected it. He got bail from the highest court of the country three times in a row and lastly on the eve of his release from prison in the holy month of Ramadan, on the eve of the holy Eid-ul-Fitr on 16th April 2023, he was again implicated in a false case and requested to be arrested. On April 27, he was produced in court and a 10-day remand application was made. The court later granted 1-day remand after the hearing. He said that on May 29, he was again granted bail by the High Court.
Right now there is no case against him. So the prison authorities cannot detain him under any circumstances. It is normal that the prison authorities will release him as soon as the bail is filed. Moreover, the Supreme Court of the country on May 17, 2022, ordered him not to be arrested and harassed. Not releasing him or arresting him or harassing him after having this direction of the court amounts to complete contempt of court.
He said we came to know that on June 13, DMP's Paltan Model Police Station applied to the court to arrest him in case No. 28 dated 25/4/2021. He has not been arrested in this case so far. It has been said that whether the arrest will be shown or not will be heard on June 19. Since there is no case against Professor Mia Golam Parwar, his detention is completely illegal and contrary to the High Court order.
In this situation, we call upon the concerned authorities to respect the laws of the country, the constitution, and the directives of the High Court by releasing Prof. Mia Golam Parwa immediately.
In response to a question, he said that in 2016, the High Court had a clear directive that if bail is obtained from the court, he cannot be re-arrested. There is no opportunity to file a new case. He said that there is no case against Professor Mia Golam Parwar. An application has been made to show him arrested in a case. The hearing on whether to show the arrest will be held on June 19. Now what law has he been detained in prison?
Advocate Jasim Uddin Sarkar said that there is no legal obstacle to releasing Professor Mia Golam Parwar. Jail authorities are repeatedly violating the law. He expressed hope that they would release him immediately if they respected the Constitution and the law.
